1. General

These Terms and Conditions govern the sale of products by PURE Eyewear EOOD ("we", "us", "our") through our website. By placing an order, you agree to be bound by these terms. We are a company registered in Bulgaria, EU, and all transactions are conducted in accordance with EU consumer protection law, including Directive 2011/83/EU on consumer rights.

2. Eligibility

To purchase from our store, you must be at least 18 years old and capable of entering into a legally binding contract. By placing an order, you confirm that all information provided is accurate and complete.

3. Product Information

We make every effort to display our products as accurately as possible, including colours, specifications, and pricing. However, we do not guarantee that your device's display accurately reflects the true colours of the products. Product descriptions and specifications are subject to change without notice.

4. Pricing & Payment

All prices are displayed in Euro (EUR) and include applicable VAT unless otherwise stated. We reserve the right to change prices at any time. Payment is processed securely through Stripe. Your order is confirmed only after we receive full payment and send you an order confirmation email.

5. Order Acceptance

Receipt of an order confirmation does not constitute acceptance of your order. We reserve the right to refuse or cancel any order for reasons including product unavailability, errors in product or pricing information, or suspected fraudulent activity. If we cancel an order after payment has been processed, we will issue a full refund.

6. Shipping & Delivery

We ship to addresses within the European Union. Delivery times are estimates and commence from the date of dispatch, not the date of order. We are not liable for delays caused by customs, carrier issues, or events beyond our reasonable control. Risk of loss and title pass to you upon delivery to the carrier.

7. Right of Withdrawal (14-Day Return)

Under EU consumer law, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw by means of a clear statement (e.g., email to support@puregoggles.com). You may use the model withdrawal form below, but it is not obligatory.

You must send the goods back to us without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal. You will bear the direct cost of returning the goods unless we have agreed otherwise. We will reimburse all payments received from you, including delivery costs (except for supplementary costs arising if you chose a delivery type other than the least expensive standard delivery), without undue delay and in any event within 14 days from the day we are informed of your decision to withdraw.

8. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

• Goods made to your specifications or clearly personalised.
• Goods which are liable to deteriorate or expire rapidly.
• Sealed goods which are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery.
• Goods which become inseparably mixed with other items after delivery.

9. Warranty

All PURE products come with a 2-year commercial warranty against manufacturing defects, in addition to your statutory rights as a consumer under EU law. This warranty does not cover damage caused by misuse, accidents, unauthorised modifications, or normal wear and tear. To make a warranty claim, contact us at support@puregoggles.com with proof of purchase.

10. Limitation of Liability

To the extent permitted by law, our total liability to you for any loss or damage arising out of or in connection with your purchase shall not exceed the total amount you paid for the relevant products. Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded under applicable law.

11. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of PURE Eyewear EOOD or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

12. Governing Law & Disputes

These Terms and Conditions are governed by the laws of the Republic of Bulgaria. If you are a consumer, you also benefit from any mandatory provisions of the law of the country in which you are resident. Any disputes shall first be attempted to be resolved amicably. EU consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
